1. Introduction
Seat Eat (“the App”) is operated on behalf of Yellow Seat, a division of The Seats Ltd, New Zealand (“we”, “us”, or “our”). We respect your privacy and are committed to protecting your personal information.
This Privacy Policy explains how we collect, use, disclose, and safeguard personal information obtained through the Seat Eat mobile and web applications (collectively, the “Platform”), developed and maintained by WebAppANZ Pty Ltd (Australia) (“Technology Provider”).
By using the Platform, you agree to the terms of this Privacy Policy. If you do not agree, please do not use the App.
2. Scope and Applicability
This Policy applies to all users of the Seat Eat App, including:
– Students (end-users) accessing menus and meal-related features; and
– Kitchen or administrative staff managing menus, attendance, and feedback.
It covers data collected within New Zealand and Australia and complies with:
– New Zealand Privacy Act 2020, and
– Australian Privacy Act 1988 (Cth), including the Australian Privacy Principles.
3. Information We Collect
We collect the following categories of information:
a) Personal Information – Name, contact details, login credentials, profile photo (if uploaded with consent), dietary preferences and allergy information, attendance, meal selections, feedback, device identifiers, IP address, and usage data.
b) Sensitive Information – Dietary and allergy information that may indicate health-related details.
c) Non-Personal Information – Aggregated, anonymised statistics, device type, operating system, and performance data.
4. How We Collect Information
We collect information:
– Directly from you when you register, update your profile, or submit feedback;
– Automatically through cookies, device identifiers, and analytics tools; and
– From administrators or authorised staff (e.g. attendance or menu management).
5. How We Use Your Information
We use your information to:
– Provide, operate, and improve the Seat Eat App and related services;
– Display menus, manage dietary preferences, and record attendance;
– Facilitate feedback and meal-preference voting;
– Communicate updates, reminders, and service notices;
– Monitor and enhance app functionality, safety, and user experience;
– Conduct analytics and internal reporting; and
– Comply with legal and regulatory obligations.
6. Legal Basis for Processing
We collect and process your personal information on the following grounds:
– Your consent (e.g., creating a profile or feedback submission);
– Performance of a service contract (meal and attendance services);
– Legitimate interests (managing and improving catering operations).
Consent will be obtained before collecting sensitive information.
7. Disclosure of Personal Information
We may disclose information to:
– WebAppANZ Pty Ltd (Australia) – technology provider under confidentiality;
– University or residential administration staff;
– Service providers (cloud hosting, IT support, analytics, data storage);
– Regulatory bodies or law enforcement; or
– Successors or assigns in case of business transfer.
We do not sell or trade personal information.
8. International Data Transfers
Personal information may be processed or stored in New Zealand or Australia. Where data is transferred across borders, we ensure comparable privacy protections in accordance with NZ Privacy Principles 12–13 and Australian Privacy Principle 8.
9. Data Retention
We retain personal information only as long as necessary for stated purposes or as required by law. When no longer needed, data is securely destroyed or de-identified.

– End-to-end encryption for data in transit and at rest;
– Restricted, role-based access controls;
– Secure hosting and regular security audits; and
– Staff confidentiality and training.
No system is completely secure; users assume associated risks.
11. Your Rights (Australia & New Zealand)
You have the right to:
– Access and obtain a copy of your information;
– Request correction or update of inaccurate data;
– Withdraw consent;
– Opt out of marketing or analytics; and
– Lodge complaints with the Office of the Privacy Commissioner (NZ) or the Office of the Australian Information Commissioner (AU).
12. Cookies and Analytics
Seat Eat may use cookies or similar technologies for login, analytics, and improving experience. You may disable cookies in your settings, but this may affect app functionality. Google Analytics or SDKs may be used in compliance with respective privacy terms.
13. Children’s Privacy
Seat Eat is intended for registered university students and authorised staff. It is not designed for individuals under 16 years of age without institutional consent.
14. Changes to This Policy
We may update this Policy periodically. The latest version will be available in-app or on our website. Continued use of the App signifies acceptance of the revised Policy
15. Account and App Deletion
You may request deletion of your Seat Eat account and associated personal data at any time.
To do so, please contact us at amit@yellowseat.co.nz (for account or data deletion requests) or info@webappanz.com.au (for technical assistance).
Once your request is verified, your account and related personal data will be securely deleted from active systems within a reasonable timeframe, unless retention is required by law or institutional policy.
If you delete the Seat Eat App from your device without contacting us, your profile information may continue to be retained in accordance with our data retention policy until a formal deletion request is received.
