Welcome to Seat Eats, a mobile and web-based application operated by Yellow Seat (The Seats Ltd, New Zealand) (“Yellow Seat”, “we”, “us”, or “our”) and developed and maintained by WebAppANZ Pty Ltd (Australia) (“WebAppANZ”, our “Technology Provider”).
By downloading, accessing, or using the Seat Eats app (“App”), you agree to these Terms and Conditions (“Terms”) and our Privacy Policy.
If you do not agree, please do not use the App.
1. Purpose of the App
Seat Eats provides a digital platform for students and kitchen staff at participating university accommodation facilities to manage food services.
Features include:
– Viewing meal menus and nutritional information
– Submitting dietary preferences and allergy information
– Ordering late meals or takeaway lunches
– Providing attendance confirmation and feedback
– Viewing and managing menu and attendance data (for kitchen staff and administrators)
Seat Eats is intended for informational, administrative, and engagement purposes only. It does not provide medical, nutritional, or professional dietary advice.
2. Definitions
– “User” means any person accessing or using the App, including students, staff, or administrators.
– “Account” means a registered profile created in the App.
– “Personal Data” means any information that identifies an individual, such as name, contact details, dietary or allergy information, and meal preferences.
– “Content” means all text, data, images, graphics, and other material displayed or entered on the App.
– “Technology Provider” means WebAppANZ Pty Ltd (Australia), which develops and supports the App on behalf of Yellow Seat.
3. Eligibility and Account Creation
You must be at least 16 years of age or have parental/guardian consent to use this App.
Users must provide accurate and complete information when creating an Account and keep login credentials secure.
You are responsible for all activities under your Account and must immediately notify us if you suspect unauthorized access.
4. User Responsibilities
You agree to:
– Use the App only for lawful purposes related to your participation in the food service program.
– Provide accurate dietary, allergy, and preference information.
– Not upload or transmit offensive, misleading, or unlawful content.
– Not attempt to hack, copy, reverse-engineer, or otherwise interfere with the App.
– Comply with all applicable Australian and New Zealand laws and university or facility policies.
5. Data Collection and Privacy
Yellow Seat is the data controller responsible for your personal information.
WebAppANZ acts as the technology provider and data processor for purposes of hosting, storage, and technical support.
By using the App, you consent to the collection and processing of your data as outlined in our Privacy Policy, including:
– Personal and dietary details (including food allergies and medical dietary restrictions provided voluntarily)
– Attendance and meal selection information
– Feedback or survey responses
– Device and usage data (for performance improvement)
All data is processed in compliance with the New Zealand Privacy Act 2020, the Australian Privacy Act 1988, and any applicable university or institutional data-protection requirements.
6. Food and Allergen Advisory Statement
Yellow Seat recognises that allergens can be a significant concern for some individuals.
If you have specific dietary requirements, you are encouraged to ask kitchen staff for additional information about menu options before consuming any food.
Please note:
– Food preparation, cooking, and serving processes may involve common allergens, including but not limited to gluten, eggs, fish, crustaceans, peanuts, tree nuts, soy, sesame, milk, and lupin.
– Despite best efforts, cross-contact or traces of allergens may still occur.
– Yellow Seat cannot guarantee that any menu item is completely free from allergens.
We will provide, on request:
– Details of product ingredients, where available.
– Disclosure if specific information is not available.
Important: The Seat Eats App is an informational tool only and does not replace direct communication with staff or professional medical advice.
Users with known food allergies or intolerances must exercise due caution and are solely responsible for verifying food safety before consumption.
7. Intellectual Property
All rights, title, and interest in and to the App, its design, code, features, and content (except user-generated data) are owned by Yellow Seat or its licensors, including WebAppANZ Pty Ltd.
You may not reproduce, distribute, or create derivative works from any part of the App without prior written consent.
8. Prohibited Conduct
You agree not to:
– Use the App for fraudulent, misleading, or harmful purposes.
– Upload or distribute malware, viruses, or other harmful code.
– Interfere with the functionality or security of the App or related networks.
– Misuse or disclose another user’s data without permission.
– Attempt to gain unauthorized access to administrative systems.
9. Disclaimer and Limitation of Liability
Seat Eats and its associated services are provided “as is” and “as available.”
To the extent permitted by law, Yellow Seat and WebAppANZ disclaim all warranties, express or implied, including any warranty of merchantability, fitness for purpose, or non-infringement.
Yellow Seat and WebAppANZ do not guarantee that:
– The App will be uninterrupted, secure, or error-free;
– All data or features will always be available; or
– All menu or allergen information is complete, accurate, or up to date.
To the maximum extent permitted by law, neither Yellow Seat nor WebAppANZ will be liable for any loss or damage arising from:
– Reliance on menu or allergen information;
– Delays, errors, or interruptions in service;
– Personal injury or illness from food consumption; or
– Unauthorized access to or use of your data.
Some rights under the Australian Consumer Law or New Zealand Consumer Guarantees Act may apply and cannot be excluded. In such cases, liability is limited to re-supplying the relevant service or refunding the cost of that service.
10. Indemnity
You agree to indemnify and hold harmless Yellow Seat, WebAppANZ, and their directors, employees, and agents from any claim, loss, or damage arising out of:
– Your misuse of the App or breach of these Terms;
– Your provision of inaccurate or incomplete information; or
– Any action related to your use of the App’s information or food service.
11. Modification and Updates
We may modify or update these Terms from time to time.
Updated versions will be posted within the App and take effect upon posting.
Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
12. Termination
We may suspend or terminate your access to the App if you breach these Terms, misuse the platform, or engage in unlawful activity.
You may stop using the App at any time. Upon termination, all rights granted to you under these Terms will cease immediately.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of New Zealand and Australia.
Any disputes shall first be attempted to be resolved amicably.
If unresolved, the dispute may be submitted to the competent courts of New Zealand or Australia, as applicable.
